Terms of Service

Preamble

 

In accordance with the law of confidence in the digital economy of 2004, this Blog, the purpose of which is to allow Internet users to share the journey of the crew of the Site "NEEL 51 WILLIWAW» throughout their journeys and this through their articles, photos, videos which will be published there for purely informative purposes.

The purpose of these General Terms and Conditions of Use (“GTU”) is therefore the legal framework of the “NEEL 51 WILLIWAW” Site accessible at the URL address   https://www.neel-51-williwaw.com/(including its associated sites accessible ou  non from this address: travel, nightmare, expertise ...) all hereinafter referred to as "the Site" and the terms that the blogger makes available Internet users. Thus the conditions define the means of access and use of the Site.

These T&Cs are accessible on the Site under the heading “General Terms and Conditions of Use”.

The Internet user who subscribes to the Site, according to the procedure set up by the Publisher, is systematically referred to his request for registration to read these GTU via the Registration Form made available to the Internet user by the Publisher and expressly accepts these GTU by ticking the box preceding the following text: "I acknowledge having read and understood the T&Cs and I accept them".

Any final registration implies full acceptance of these GTU.

“NEEL 51 WILLIWAW” may modify the terms of the GTU at any time. The User is expressly informed that the version in force is the one posted at the address URL  www.neel-51-williwaw.com, on the date of access to any of the Services, which the User acknowledges and accepts without restriction, undertaking to refer to it systematically during each connection.

 

Warning: the legal numerical majority, ie the age from which a minor can consent alone to the processing of his personal data to use a service on the Internet, is fixed at 15 years. Parental authorization is therefore required before this age.

Site Definitions

“User”: this term designates any person who visits and/or connects to the Site and/or to another of the services offered by the Site.

​​ "Member": this term refers to any User who registers on the Site and whose registration is validated by the "Publisher". He is aware that the site is for sharing experience and undertakes not to misuse and/or misuse it.

“Editor”: this term refers to the person who created and wrote the Site “NEEL 51 WILLIWAW".

"Cookies": this term designates the text files deposited or read on the User's terminal recording their browsing data.

I. Accessibility

The Site is accessible free of charge anywhere and to any User with Internet access, after registration as a "member" validated by the Publisher.

To create an account, the User must complete a registration form by providing personal information, such as in particular the surname, first name, email address.

The User agrees to

If someone other than the User accesses their Member Account and/or any of its settings, they will be able to perform all actions that are accessible to the User, including making changes to their Member Account. Therefore, we  strongly encourage User to keep Member Account login credentials safe. All such activities may be considered to have taken place in his name and his account, and he shall be solely responsible for all activities that take place on his Member Account, whether he has specifically authorized them or not, and for all damages , expenses or losses that may result from these activities. The User is responsible for the activities carried out on his Member Account in the manner described if he allowed the use of your Member Account by negligence, by not taking reasonable care to protect his login credentials.

The User undertakes to create only one account. The creation of several accounts for the purpose of disruption, to cause trouble, to diminish the confidence of the site or the Services is prohibited. Any misuse will result in the closure of all accounts and a permanent ban from the Site and Applications.

All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are his responsibility.

The Site implements all the means at its disposal to ensure the User quality access to its services.

Any event due to a case of force majeure resulting in a malfunction of the network or the server does not engage the responsibility of the Publisher.

Access to the services of the Site may at any time be subject to interruption, suspension, modification without notice for maintenance or for any other case and this without prejudice to the User.

The User undertakes not to claim any compensation following the interruption, suspension or modification of the Site.

II. Personal data

Registration on the Site involves the collection and processing of the User's personal data. In any case, the User accepts that his personal data will be processed and stored when necessary for his registration. 

The User at the very moment of his registration on the Site is deemed to have consented to these T&Cs.

The User agrees that the Site Editor, in its capacity as data controller, processes the data collected, which will be kept only for the time necessary to achieve the objective pursued by the Site (see Preamble).

The data processing officer (the Publisher) undertakes never to disclose this data to third parties in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons at with regard to personal processing and the free movement of such data (general data protection regulation, known as GDPR) which repeals Directive 95/46/EC of October 24, 1995 of the same name.

Exercise of rights relating to personal data:

In accordance with the data-processing law and freedoms N°78-17 of January 6, 1978, the User has a right of access, rectification, opposition, deletion of his data.

To exercise them, simply send an email to the Publisher at the address neel51williwaw@gmail.com  to request its modification or deletion. The Publisher will confirm that it has processed your request as soon as possible.

In the event of a breach of data security involving a high risk, the controller undertakes to immediately notify the User and notify the Commission for the Protection of Privacy (CPVP) within 72 hours after the " awareness" in accordance with the law.

III. Cookies Policy

“Cookies” are small files temporarily stored on the User's computer hard drive by their browser. Cookies do not contain personal information and cannot be used to identify someone. A “cookie” contains a unique, randomly generated and therefore anonymous identifier. Some "cookies" expire at the end of the User's visit, others remain.

The Website "NEEL 51 WILLIWAW» may use “cookie” techniques enabling it to process statistics and information on traffic, to facilitate navigation and to improve the service for the comfort of the User.

The User may oppose the recording of these "cookies" by configuring their browser software.

IV. Intellectual property

The Site holds the rights to all of the content, that is to say the elements posted on the Site.

The copyright of the Site relates in particular to the rights created at the time of the graphic design of the Site, that is to say the images, the representations, the originality of the Site and to all the articles published and more generally all the content of the Site, exit the trademarks of partners belonging to the latter, are and remain the exclusive property of the creator of the Site (see Legal notices).

The photos of the members of the crew belong exclusively to the members of the Crew as well as the photos taken by the members of the crew.

Also the User is prohibited from copying, distributing, reproducing all or part of the Site in any form whatsoever except after prior and express authorization from the Publisher, however, copies recorded "under" are authorized but only for exclusive purposes of information for personal and private use.

Nothing in these Terms or in the content of the Site shall be interpreted as directly or implicitly granting any license or right other than that of consulting the Site.

The Site reminds that any attack on the integrity of the Site is likely to result in the liability of its author who is exposed to legal proceedings.

V. Responsibilities

The Publisher may interrupt all or part of the access to the Site, in particular for reasons of maintenance and upgrading. Access may also be interrupted for any other reason, in particular technical or legal.

The Site Editor is in no way responsible for these interruptions or the consequences that may result from them. It may also change or remove some of the features. Nevertheless, the Site Publisher, if it can, given the technical constraints, undertakes to warn its Users by all the means at its disposal.

The User also acknowledges accepting the constraints and limits of the Internet network, in particular with regard to the transmission of information data via the networks and data breaches.

The Site cannot be held responsible for any viruses that could infect the computer or any computer equipment of the User, following use, access, or download from the Site.

Consequently, the Site cannot be held responsible for technical problems independent of the services offered by the Site, such as communication problems due to the User's Internet service provider (slowness or interruption). The User is therefore solely responsible for the use made of the Site and cannot hold the Publisher liable.

In the event of a User's failure to comply with any of the provisions of the GTU, or more generally of a breach of laws and regulations by the User, the Site reserves the right to take all appropriate measures and in the cases more serious to take legal action.

VI. Advertising

The Site reserves the right to insert on any page of the Site and in any communication to the User any advertising message in the form and under the conditions of which the Publisher will be the sole judge, particularly in the context of its partnerships.

VII. Hypertext links

The Site may contain hypertext links pointing to other websites independent of the Site. Indeed, the Site Editor authorizes the establishment of hypertext links to any page or document of partner sites for advertising or commercial purposes.

However, and despite the prior and regular checks carried out by the Publisher, the latter declines all responsibility for the content that can be found on these sites.

The Publisher reserves the right to have a hypertext link pointing to its site removed at any time if it deems it does not comply with its editorial policy.

VIII. Posts by the User

The site allows the User to post comments following blog articles (“Your posts”).

In his publications, the User undertakes to respect the rules of Netiquette (rules of good conduct of the Internet) and the rules of law in force.

The Site may exercise moderation on publications and reserves the right to refuse to put them online, without having to justify this to the User.

The User remains the holder of all of his intellectual property rights. But by publishing a publication on the Site, he assigns to the Publisher the non-exclusive and free right to represent, reproduce, adapt, modify, distribute and distribute his publication, directly or through an authorized third party, worldwide, on any medium (digital or physical), for the duration of the intellectual property. In particular, the User assigns the right to use his publication on the Internet and on mobile telephone networks. The Publisher undertakes to include the member's name near each use of its publication.

Any content posted by the User is his sole responsibility.

 

The User agrees not to upload content that may harm the interests of third parties. Any legal action brought by an injured third party against the site will be borne by the User.

The User's content may be deleted or modified by the Site at any time and for any reason, without notice.

IX. Consultation and evolution of the T&Cs

The T&Cs can also be sent free of charge to any person who requests them from the Publisher. The T&Cs can be modified at any time without prejudice to the User.

X. Duration

The duration of these terms of use is indefinite. They produce their effects with regard to the User from the use of the service.

XI. Applicable law and competent jurisdiction

Belgian law applies to these T&Cs. In the event of absence of amicable resolution of a dispute arising between the parties, the Belgian courts will have sole jurisdiction to hear it.
